The first version of the RoHS directive on the restriction of certain hazardous elements and chemicals in electrical and electronic equipment was published in 2003. The second version of this directive, which is in force in the European Union, was put into effect in January 2013. What is different from the previous directive of this second directive is the compliance with the New Legislative Framework of the European Union and the REACH Regulation.

The new Legislative Framework was developed to enhance and strengthen market surveillance and control, strengthen product conformity assessment, and improve the reliability of the CE marking. There are two applications that make up this new regulatory framework:

  • Regulation on market accreditation and market surveillance of products 765 / 2008 / EC
  • Decision establishing the general framework of the introduction of products 768 / 2008 / EC

The new version of the RoHS directive states that the procedures should comply with the European Parliament and Council Decision 768 / 2008 / EC for the assessment of the suitability of electrical and electronic equipment subject to the directive. He also referred to Regulation 765 / 2008 / EC on the general principles for the CE marking.

The first version of the RoHS directive covered eight categories. The new version of the RoHS directive adds three new categories to these categories and includes all electrical and electronic equipment.

As of January 2013, the RoHS new directive will be applied to the eight categories of electrical and electronic equipment, and a gradual transition will be made to the new categories. Below are the transition dates for electrical and electronic equipment that fall into three new categories:

  1. Large Home Appliances
  2. Small Home Appliances
  3. Computer technologies and telecommunications goods
  4. Consumer goods
  5. Lighting devices (bulbs and chandeliers included)
  6. Electrical and electronic tools
  7. Toys, entertainment and sports equipment
  8. Medical Devices (July 2014) - Invitro Diagnostic Medical Devices (July 2016)
  9. Monitoring and control instruments (July 2014) - Industrial monitoring and control instruments (July 2017)
  10. Automatic dispensers
  11. Other electrical and electronic goods not covered by the above categories (July 2019)
