The Ministry of Industry and Trade issued the Machinery Safety Regulation (2009 / 2006 / AT) in 42. The machines used in various sectors must be properly installed, regularly maintained and used for the purposes expected from them. In this case, the machines should not cause any harm to human health and safety and to domestic animals and goods when operating. In order to ensure the sale and commissioning of such machines,

  • Basic safety conditions to be observed in design and production processes,
  • The conformity assessment processes to be followed, and
  • To regulate the minimum criteria to be taken into account in the appointment of notified bodies that will conduct conformity assessment.

In Annex 4, which is an annex of this regulation, the regulation 13. The third and fourth paragraphs of the article of the process to be applied to one of the categories of machinery are described. Article 13 carries the conformity assessment procedures of the machines. The third and fourth paragraphs of this article are the procedures to be carried out by the manufacturer or its authorized representative, provided that the standards cover all relevant basic health and safety rules on machines manufactured in accordance with the harmonized standards.

In this case, the enterprises described in Annex 4 and wishing to obtain the CE certificate for machine categories must apply to a notified body. There are several machine categories in this article:

  • Various types of single or multi-blade circular saws for processing wood, meat or similar materials with physical properties
  • Manual feeding planers for woodworking
  • Planing machines with a mechanical combined feeder for woodworking
  • Manual feed mortising machines for wood processing
  • Vertical spindle cutters used to process wood
  • Portable chain saws for wood processing
  • Presses for cold processing of metal materials
  • Plastic molding machines
  • Rubber molding machines
  • Locomotives and decovils used in underground works and hydraulic powered ceiling supports
  • Garbage trucks with compactors
  • Detachable mechanical transmission and transmission devices and guards
  • Vehicle maintenance lifts
  • Protective devices used to detect the presence of persons
  • Logic units used to provide safety functions
  • Roll-over protection structures
  • Protective structures against falling objects

For all machine groups listed in the annex 4, enterprises wishing to obtain CE certification must first apply to a notified body.

It is not possible for products without CE mark to enter the European Union markets and be offered to consumers. However, there are some rules that must be followed for enterprises to put CE marking on their products. The key point here is how much risk products are to consumers. In the New Approach Directives governing the application of the CE marking, conformity assessment procedures are regulated differently according to the degree of risk that the products carry.

If the product carries a low risk, the manufacturer can only make a declaration of conformity under his responsibility and put the CE mark on the product. However, if the product carries a high risk, these products must undergo a notified body inspection. These notified bodies are those which act impartially and independently and whose names are published in the Official Journal of the European Union.

It is essential that the machine groups within the scope of Annex 4 described above are subject to a conformity assessment by such an organization. After the testing, inspection and evaluation of this organization, manufacturers can put CE marking on their products.
